and to use them. This license is exclusively meant to use and benefit from our Services in accordance with the present Terms, excluding any right to copy, modify, distribute, sell, rent all or part of the software. It is the same with decompilation or source code extraction rights, except in cases where decompilation is authorized by law and within the boundaries of such law.   <\/p><p>Unless explicitly agreed otherwise, no licence to use the QWANT Application Programming Interfaces (API) is granted to the User for any use other than within the framework of the Services published by QWANT. Users with a User Account may configure the display of Flash Answer and save this choice under the conditions set out in the User Account Special Conditions. <\/span><span style=\"font-weight: 400\"> <\/span><\/p><p><span style=\"font-weight: 400\">Queries and Results are not subject to any history or backup whatsoever, either by Qwant or by third-party Providers. Queries submitted by the User when using Flash Answer are stored only by Qwant and its advertising partners and are not linked to any Session, it being specified that a \u201cSession\u201d means the continuous period during which the User interacts with Flash Answer, from its opening to its closing. <\/span><\/p><p><span style=\"font-weight: 400\">Apart from the transmission of the Query strictly necessary for the operation of Flash Answer, data flows are identical to those applicable to the use of the search engine currently offered by Qwant.<\/span><\/p><p><span style=\"font-weight: 400\">Qwant reminds the User that the User is responsible for their Queries and must, in particular, ensure that they do not violate any applicable law or the present Terms. The User represents and warrants that they hold all rights, licences and authorisations necessary to submit Queries.  <\/span><\/p><p><span style=\"font-weight: 400\">Qwant reminds the User that Flash Answer relies on artificial intelligence Models developed by third-party providers. As such, Qwant merely makes these tools, adapted to Flash Answer, available to Users. The User remains responsible for the interpretation and use they make of the Results.  <\/span><\/p><p><span style=\"font-weight: 400\">Queries and data submitted by Users are processed solely in order to produce the requested answer. They are neither stored nor used for training or improving the Models, or for any other purpose (Zero Data Retention). In this context, certain rights and obligations relating to the Results provided through Flash Answer    <\/span>may depend on the contractual terms applied by our model providers, Mistral AI and OpenAI. Accordingly, the following terms apply: <a href=\"https:\/\/legal.mistral.ai\/terms\/commercial-terms-of-service\" target=\"_blank\" rel=\"noopener\">Mistral AI terms<\/a>; <a href=\"https:\/\/openai.com\/policies\/services-agreement\/\" target=\"_blank\" rel=\"noopener\">OpenAI terms<\/a>. <\/p><h5><strong>Intellectual property <\/strong><\/h5><p>Qwant grants the User a personal, revocable, non-exclusive, non-sublicensable and non-transferable licence to use Flash<span style=\"font-weight: 400\"> Answer for the duration of the present Terms. The User acknowledges Qwant\u2019s intellectual property rights in Flash Answer, its components and the related Content, and waives any right to challenge these rights in any form whatsoever. <\/span><\/p><p><span style=\"font-weight: 400\">Qwant does not claim any ownership rights in the Queries or in the Result obtained. The User grants Qwant a limited intellectual property licence authorising Qwant solely to process the Queries and to provide the Result in accordance with the Privacy Policy and the present Terms, and to comply with its legal obligations. <\/span><\/p><p><span style=\"font-weight: 400\">The trademarks, logos, slogans, graphics, photographs, animations, videos, software solutions and texts, and any other Content on Flash Answer, are the exclusive intellectual property of Qwant and may not be reproduced, used or represented without Qwant\u2019s express authorisation, under penalty of prosecution.<\/span><\/p><p><span style=\"font-weight: 400\">Any total or partial representation or reproduction of Flash Answer and its Content, by any means whatsoever, without Qwant\u2019s prior express authorisation, is prohibited and constitutes an infringement punishable under Articles L. 335-2 et seq. and L. 713-1 et seq. of the French Intellectual Property Code.<\/span><\/p><p>It is expressly prohibited to use the Results and\/or any modified or derivative version of the Results in order to reverse engineer, directly or indirectly, Flash Answer or the Models.<\/p><p><span style=\"font-weight: 400\">The User grants Qwant a worldwide, irrevocable, non-exclusive, non-sublicensable and non-transferable right to use the feedback they provide on Flash Answer in order to improve it, in particular the accuracy of the Results. This licence is granted for the duration of the intellectual property rights. <\/span><\/p><h5><strong>Result <\/strong><\/h5><p><span style=\"font-weight: 400\">The User accepts that, due to the nature of Flash Answer, Flash Answer may generate similar or identical Results. Consequently, and unless otherwise stated, Qwant will not compensate the User where their Results are similar or identical to the Results of another User. <\/span><\/p><p><span style=\"font-weight: 400\">The User acknowledges and accepts that Flash Answer is inherently subject to a degree of unpredictability, in particular with regard to the Results. These Results depend on the keywords entered, the search engine index, the version of the LLM used on the date of the Query, and the content of the websites used, as the technology behind Flash Answer is complex and constantly evolving. Flash Answer is therefore provided without any express or implied warranty as to the quality or accuracy of the Results. Consequently, you accept that the Results generated by Flash Answer may be incomplete, not up to date, approximate or sometimes obsolete. You are strongly advised not to rely on a Result without checking its content against other sources, in particular for professional advice (medical, financial or legal).
