Special conditions of use of Qwant Maps

Welcome to QWANT MAPS!
The purpose of these Special Conditions of Use (hereinafter referred to as the CPU) is to define the terms and conditions of use of the QWANT MAPS service.
We reserve the right to modify the QWANT MAPS site and/or service as well as these CPU’s at any time, in order to adapt them to changes in the service and/or its operation. You will be informed of these modifications by e-mail or by any other means of posting on the Services before they come into force.
NB: The French text constitutes the official version and will prevail in the event of any discrepancy between the different versions of these GCU.
Description of the QWANT MAPS service
The QWANT MAPS service allows the user to display information in a geographical context requested by the user, such as map data or descriptions of places of interest (e.g. public transport stops, shops, public establishments, etc.). The information displayed is that collected by Qwant or offered by its partners and users.
Accessible free of charge and reserved exclusively for non-professional and non-commercial use, QWANT MAPS can be used directly by consulting the address https://www.qwant.com/maps or be displayed in the search results when querying the Qwant.com search engine.
Intellectual property rights
All the elements presented on the pages of QWANT MAPS are covered by intellectual property rights. You expressly acknowledge and accept that the trademarks and logos of QWANT and QWANT MAPS as well as the graphic elements of the QWANT MAPS user interface are, unless otherwise stated, the exclusive property of Qwant, and that the other trademarks and logos displayed are the property of their respective owners.
For the purposes of graphical display of map data, QWANT MAPS uses software from the OpenMapTiles project, the source code of which is made available under 3-CLAUSES BSD licences. The visual elements of the tiles are published by Qwant under the CC-BY 4.0 licence.
You can find on the following page all the contributions to free software made or used by QWANT MAPS: Github repository.
QWANT MAPS can also display elements from databases provided by its partners, such as information sheets on professionals, descriptions, consumer notices, addresses, opening hours or telephone numbers. The identity of the partner(s) is indicated next to the information concerned. In the absence of any indication to the contrary, the elements displayed from such databases are the exclusive property of the partners who do not grant any right of reproduction or adaptation to the end user.
The use of QWANT Maps does not grant you any intellectual property rights on the contents and information displayed.

Responsibility of Qwant
Qwant makes every effort to offer a service that meets the expectations of its users. You nevertheless acknowledge that the QWANT MAPS service is provided to you without any guarantee of availability or accuracy of the information displayed, whether from its own or third party databases. The information displayed on QWANT MAPS is provided to you for information purposes only and Qwant therefore recommends that you use it with all necessary caution. You acknowledge that Qwant cannot be held liable in the event that information obtained through the use of the QWANT MAPS service proves to be inaccurate or imprecise.
Qwant cannot be held responsible for any damage, suffered by you or any third party, due to the non-respect of the obligations incumbent upon you under the terms of the Special Conditions of Use or which would result from the use that you make of the QWANT MAPS service or from the permanent or temporary inability to use it.
The notices displayed are extracted from databases of third party partners identified as such, and/or Internet users who submit them freely and engage their own responsibility. Qwant is the host of these opinions within the meaning of article 6.I-2 of the law for confidence in the digital economy (LCEN) of 21 June 2014 and does not exercise any editorial control over them. Consequently, these opinions do not reflect the opinion of Qwant and Qwant cannot be held liable, in particular in the event of loss of business, commercial prejudice, loss of customers, commercial disruption of any kind, loss of profits, or loss of brand image.
The information displayed may facilitate your contact with third parties. You expressly acknowledge that Qwant cannot be held responsible for any damage resulting from this relationship.
Responsibility of the user
Qwant grants you the right to use the QWANT MAPS service only under the conditions provided herein. You agree to make reasonable and lawful use of the service and in particular not to :
- Reproduce or integrate the content of QWANT MAPS on a website or an application by removing or making invisible all or part of the interface of the service and in particular its logos and search fields;
- Alter, move or delete mentions relating to the intellectual property of Qwant or its partners that appear on the interfaces;
- Extract directly or indirectly all or part of the databases of Qwant Maps and its partners for purposes other than the normal use of Qwant Maps, except, through the download links specifically made available, the open databases used and shared by Qwant Maps;
- Use QWANT MAPS to invade the privacy of an individual, to promote illegal activities, to incite to harm the physical or moral integrity of an individual or a group of individuals;
- Use Qwant Maps for commercial or professional purposes without the specific and explicit authorization of Qwant.
You acknowledge that Qwant may take legal action against you in case of violation of the present terms, in particular if your use of QWANT MAPS damages its interests, reputation, honour or brand image.
Protection of your personal data
Our commitments to the protection of your privacy and personal data are available here and apply to the QWANT MAPS service. When you request to enable geolocation on QWANT MAPS, your browser or application will return to Qwant a geographical position that is not maintained by Qwant. It is used temporarily to refine your request and thus centre the displayed map, and to indicate the geographical point corresponding to the returned position. However, we encourage you to deactivate geolocation whenever it is no longer necessary.
Modification, interruption or deletion of the QWANT MAPS service
Qwant reserves the right to modify, temporarily interrupt or permanently discontinue the QWANT MAPS service at any time without notice. Qwant cannot be held responsible for the unavailability, temporary or permanent, total or partial, of the QWANT MAPS service.
